When an individual is killed as the result of another person’s error or negligence, the family of the victim may have a right to hold the parties responsible for their loss liable for damages. The Pennsylvania Wrongful Death Attorneys with Lundy Law explain the widow of a truck driver who was killed in an accident recently filed such a claim successfully.

A story from the Lebanon Daily News stated the incident occurred November 13, 2009, at the intersection of I-81 and I-78 in Lebanon County. Reports indicate the 48-year-old driver of a tractor-trailer missed his turn onto I-81. He then attempted to back the truck up to make the turn at roughly 17 MPH with no lights or warnings to other motorists. As the truck was backing up though, the 36-year-old driver of another big rig failed to realize the vehicle was in reverse in front of him and plowed into the rear of the truck. The impact of the collision killed the 36-year-old victim and another passenger in his vehicle instantly.

The widow of the victim filed suit against the truck driver responsible for the crash and his company, claiming his negligence was directly responsible for her loss. A judge agreed, citing the driver was unfamiliar with the route and equipment, and had failed to complete any on-the-job training.
